Joan Jett Settles Lawsuit with Hot Topic Over Lingerie Line

The lingerie advertising used the Blackheart Records logo…
Law360 reports that Joan Jett has settled her lawsuit against retailer Hot Topic for using her Blackheart logo for the company’s lingerie line.
The suit was filed last year when the store’s merchandise line “Lingerie for Girls Who Rock Roll” had snakeprint push-up bras and skull-and-crossbones-emblazoned panties. Jett claimed this constituted false advertising, unfair competition, and was “geared towards trading off the substantial goodwill associated” with Blackheart Records.
Hot Topic had been purchasing Blackheart Record’s own line of clothing and accessories since the 1990s before approaching the company in 2010 in order to distribute an exclusive line of Joan Jett-inspired merchandise. After that, Hot Topic started the lingerie line. When Jett made the complaint, Hot Topic responded with that the company “takes the rights of artists very seriously” and had compensated Jett “with mutually agreed-upon license agreements for the sale of tee shirts featuring her image.” Hot Topic said the image was theirs to use because Jett had renounced her trademark logo by that point.
Per the ruling by Judge Denise Cote, she approved a joint motion from both parties to end the proceedings. No further details on the issue were provided.
